Last Try™ privacy policy
Last Try
cares about your personal information and how it is used and shared. This
privacy policy discloses how we collect, use and share information gathered
about you on our Web site. We hope it will help increase your confidence in our
site and enhance your experience. We also encourage you to read our
Terms and Conditions.
WHAT TYPES
OF INFORMATION Last Try COLLECTING AND HOW IS THE SITE COLLECTING IT?
Many of
the services and products on our sites are available for viewing without our
collecting any personally identifiable information from you. You can visit the
Last Try Web site and see much of our content anonymously.
Information You Provide
Non-Account Activity. You can watch videos on Last Try without having a Last
Try Account. You can also contact us about a particular video without having a
Last Try Account.
Account-Related Activity. Certain other activities on Last Try—such as
uploading videos, posting comments, flagging videos, or watching restricted
videos—require you to have a Last Try Account. We ask for some personal
information when you create a Last Try Account, including your email address
and a password, which is used to protect your account from unauthorized access.
Usage
Information. We may record information about your usage, such as when you use
Last Try, the categories, groups, and favorites you subscribe to, the contacts
you communicate with, the videos you watch, and the frequency and size of data
transfers, as well as information you display or click on in Last Try
(including user interface elements, settings, and other information). If you are
logged in, we may associate that information with your account. We may use clear
images such as GIFs (a.k.a. "Web Beacons") in HTML-based emails sent to our
users to track which emails are opened by recipients.
Content
Uploaded to Site. Any personal information or video content that you voluntarily
disclose online (on discussion boards, in messages and chat areas, within your
playback or profile pages, etc.) becomes viewable by the general public and can
be collected and used by others.
Information Collected from You with Technology
Using
certain technology, Last Try collects certain information about you, so it may
not be obvious to you that it is being collected. That information may include
your IP address, your domain server, your type of computer, your type of web
browser, and statistical information regarding the pages that you visit. Last
Try uses information collected through technology to make our sites more
interesting and useful to you. For example, statistical information can help us
track which areas of a site are more popular, so that we can better customize
content to the interests of our visitors. We will combine information collected
using technology with personally identifiable information only to identify a
visitor in order to protect our service, site, guests or others, when required
by law, or when needed to help resolve a technical issue a guest may be having
while viewing the site.
Information that is Publicly Available
When you
create an account on the site, some information about your account and your
account activity will be provided to other users of the site. This may include
the date you opened your account, the date you last logged into your account,
your age (if you choose to make it public), the country and the number of videos
you have watched.
Your
account name (not your email address) is displayed to other users when you
engage in certain activity on the site, such as you upload videos or send
messages through the Last Try Web site. Other users can contact you through
messages and comments.
You may
also choose to add personal information that will be visible to other users on
your channel page (which is the public facing page for your account on the
site). This may include a profile picture, you name, gender, relationship
status, or other details.
If you
choose to add certain features to your channel page, then these features and
your activity associated with these features will be displayed to other users
and may be aggregated and shared with your confirmed friends or other users.
Such shared activity may include what videos you mark as "favorite," what videos
you rated and what videos you have uploaded.
Any videos
that you submit to the Last Try Web site may be redistributed through the
internet and other media channels, and may be viewed by the general public.
HOW DOES
Last Try USE THE COLLECTED INFORMATION?
If you
submit personally identifiable information to us through the Last Try Web site,
we use your personal information to operate, maintain, and provide to you the
general and personalized features and functionality of the Last Try Web site.
We also use your personal information to process any flagging activity or
correspondence you send to us.
Your
account name (not your email address) is displayed to other users when you
upload videos or send messages through the Last Try Web site. Other users can
contact you through messages and comments. We do not use your email address or
other personally identifiable information to send commercial or marketing
messages without your consent or except as part of a specific program or feature
for which you will have the ability to opt-in or opt-out by visiting your
account profile page. We may, however, use your email address without further
consent for non-marketing or administrative purposes (such as notifying you of
major Last Try Web site changes or for customer service purposes).
We also
use information collected to notify you if you've won a contest and to send you
e-mail updates and newsletters. You may opt-out of any email updates,
newsletters and contests by visiting your account profile page.
We use
cookies, clear images such as GIFs, and log file information to: (a) store
information so that you will not have to re-enter it during your visit or the
next time you visit the Last Try Web sites; (b) provide custom, personalized
content and information; (c) monitor the effectiveness of our marketing
campaigns; (d) monitor aggregate metrics such as total number of visitors, pages
viewed, etc.; and (e) track your entries, submissions, and status in promotions,
sweepstakes, and contests.
You can
choose to have your computer warn you each time a cookie is being sent, or you
can choose to turn off all cookies. You do this through your browser (like
Firefox, Internet Explorer or Safari) settings. Each browser is a little
different, so look at your browser Help menu to learn the correct way to modify
your cookies. If you turn cookies off, you won't have access to some Last Try
features that make your Web experience more efficient, and some services may not
function properly.
DOES Last
Try SHARE INFORMATION WITH COMPANIES OR OTHER ORGANIZATIONS THAT ARE NOT A PART
OF THE Last Try WEB SITE?
Last Try
allows other companies, called third-party ad servers or ad networks, to serve
advertisements within the Last Try Web site. These third-party ad servers or ad
networks use technology to send, directly to your browser, the advertisements
and links that appear on the Last Try Web site. They automatically receive your
IP address when this happens. They may also use other technologies (such as
cookies, JavaScript, or Web Beacons) to measure the effectiveness of their
advertisements and to personalize the advertising content you see.
Last Try
does not provide any personally identifiable information to these third-party ad
servers or ad networks without your consent or except as part of a specific
program or feature for which you will have the ability to opt-in or opt-out.
However, please note that if an advertiser asks Last Try to show an
advertisement to a certain audience (for example, men ages 18-34) or audience
segment (for example, men ages 18-24 who have viewed certain channels of
content) and you respond to that advertisement, the advertiser or ad-server may
conclude that you fit the description of the audience they are trying to reach.
The advertiser may also use information regarding your use of the Last Try Web
site, such as the number of times you viewed an ad (but not any personally
identifiable information), in order to determine which ads you may want to see.
You should
consult the respective privacy policies of these third-party ad servers or ad
networks (see links below) for more information on their practices and for
instructions on how to opt-out of certain practices. Last Try's privacy policy
does not apply to, and we cannot control the activities of, such other
advertisers or web sites. Any data obtained by third-party ad servers
subsequently shared with Last Try is maintained and handled by Last Try in
accordance with this privacy policy.
You are
the most valuable asset to our business. We are not in the business of selling
your information. However, if there is a value for our guests, we will share
your information or send you messages on behalf of another company. For example,
if you buy a Last Try T-shirt, we need to share your information with any
companies we hire to help us deliver products or services, like a shipping
company. Or, if we offer a promotion--like sweepstakes or free subscriptions--in
conjunction with a sponsor, we will share your information with the sponsors if
they need it to send you a product, such as a magazine subscription or contest
prize. We may share your information with those sponsors so that they can send
you other special promotions they offer, but only if you give us your permission
to do so, and we will share it only with that specific sponsor. In addition,
Last Try may occasionally send e-mail promotions on behalf of third-party
sponsors. In this instance, we don't share your name with the third party--we do
the mailing for them. Furthermore, Last Try may send email newsletters from our
marketing and editorial team to inform you of new content, services, member
updates and general updates. We may also share your information with our
corporate affiliates, including, but not limited to, any entity directly or
indirectly controlling, controlled by, or under common control with us.
Organizations That Help Protect the Security and Safety of Our Guests and Our
Sites
We will
give out personal information as required by law, for example, to comply with a
court order or subpoena; to enforce our Terms and Conditions, or site rules; or
to protect the safety and security of guests and our Web site.
WHAT
CHOICES DO I HAVE ABOUT Last Try COLLECTING, USING, AND SHARING MY INFORMATION?
It is
possible for you to use much of our site without giving us any personally
identifiable information. When you do register with us or give us personally
identifiable information, you will have an opportunity at the time we collect
your information to limit e-mail communications from Last Try and from our
third-party partners. You can request at any time that Last Try not send future
e-mail to you by unsubscribing by using the instructions included in each
e-mail, or by filling out the remove form located here. Also, as mentioned
above, there are ways to limit the information collected through
technology--though some of our features won't work if you decide to do this. For
the safety of minors, we request that children under the age of 18 not fill out
any personal information on our Web site without first receiving the approval of
a parent or guardian.
You may
update or correct your personal profile information and email preferences at any
time by visiting your account profile page.
